General Information Notice on the Processing and Protection of Personal Data

As ARTAŞ HOLDİNG ANONİM ŞİRKETİ (“ARTAŞ”), acting as the data controller, registered under MERSIS No. 0085040014594965 and having its registered office at 7-8-9-10. Kısım Mah. Çobançeşme E-5 Yan Yol Cad. No:8/2/1-6 Ataköy Bakırköy/Istanbul, we hereby provide you with the following information within the scope of our obligation to inform, in order to ensure that the personal data we obtain from our customers is processed in compliance with Personal Data Protection Law No. 6698 (“Law” or “KVKK”).

Within the scope of promotional, advertising, campaign, sales and marketing activities relating to the products and services offered by Artaş, its affiliated companies, group companies and subsidiaries, your name and surname (“Identity Data”), e-mail address and GSM/mobile phone number (“Contact Data”), as well as the messages you submit to us, are collected, recorded and processed for the purposes of providing you with information about projects in which you are interested, our company's campaigns, special offers, events and discounts, and for following up on your requests and complaints. Such data is collected through forms available on our relevant websites and through forms or messaging features on Instagram, Facebook, LinkedIn and YouTube platforms, pursuant to Article 5(2)(d) of Personal Data Protection Law No. 6698 (“KVKK”).

Furthermore, within the scope of Law No. 6563 on the Regulation of Electronic Commerce, the Regulation on Commercial Communication and Commercial Electronic Messages dated 15 July 2015, and the Regulation Amending the Regulation on Commercial Communication and Commercial Electronic Messages dated 4 January 2020, Artaş, in its capacity as a service provider, will process your personal data through the data collection methods specified above for the purpose of sending you commercial electronic communications by ARTAŞ and its registered trademarks regarding projects in which you are interested, our company's campaigns, special offers, events and discounts. Your personal data will also be transferred to our central CRM system, which is used by our other group companies, and such processing will continue until you exercise your right to refuse the receipt of commercial electronic communications.

The consent you provide when submitting the contact forms for the purpose of receiving commercial electronic communications shall be deemed your explicit consent within the scope of Article 5(1) of the KVKK, which you may withdraw at any time without any restriction. In addition, your Identity Data and Contact Data will be transferred to the Message Management System (İleti Yönetim Sistemi – İYS) for the purpose of providing information to authorized persons, institutions and organizations, based on the legal ground of “being expressly provided for by law” under Article 5(2)(a) of the Law.

Your personal data will be retained for the periods prescribed under the applicable legislation or for as long as required for the purposes for which it is processed. Upon expiry of the applicable retention period, your personal data will be deleted, destroyed or anonymized in accordance with the provisions of the KVKK.

With respect to all of the foregoing, pursuant to Article 11 of the KVKK regulating the rights of data subjects, you have the right to: learn whether your personal data is being processed; request information if your personal data has been processed; learn the purpose of processing your personal data and whether it is being used in accordance with such purpose; know the third parties to whom your personal data has been transferred domestically or abroad; request the rectification of your personal data if it has been processed incompletely or inaccurately; request the deletion or destruction of your personal data; request that the rectification, deletion or destruction of your personal data be notified to third parties to whom your personal data has been transferred; object to any result arising against you as a consequence of the analysis of your processed data exclusively through automated systems; and request compensation for damages incurred as a result of the unlawful processing of your personal data.

You may submit your requests concerning your rights under Article 11 of the Law at any time, in accordance with the KVKK and the Communiqué on the Procedures and Principles of Application to the Data Controller, to the Company's e-mail address at info@artasholding.com, via your registered electronic mail (KEP) address, or by using a secure electronic signature, mobile signature, or an e-mail address previously notified by the data subject to the data controller and registered in the data controller's systems.

Explicit Consent Text Regarding the Processing and Transfer of Personal Data and the Sending of Commercial Electronic Communications

This text contains your explicit consent, within the scope of Law No. 6563 on the Regulation of Electronic Commerce and the Regulation on Commercial Communication and Commercial Electronic Messages, for ARTAŞ HOLDİNG A.Ş., its affiliated companies, group companies and subsidiaries to send you commercial electronic communications via SMS, instant notifications, e-mail, telephone calls, social media, online advertising networks and similar electronic communication channels for promotional, advertising, campaign, sales, marketing, celebration and informational purposes relating to the products and services they offer, and for your name, surname, e-mail address and telephone information to be processed and transferred to the CRM system.

By submitting this form, you acknowledge that you have been informed about the commercial electronic communications to be sent to you, that you give your explicit consent to receiving such commercial electronic communications, and that you may refuse to receive such communications at any time without providing any reason.
